This Privacy Policy governs the use of the services provided by Duelity Intelligence through its websites, including the offering and sale of Duelity Intelligence PSA consulting services, technical support for Users, and the sending of newsletters and marketing information regarding Duelity Intelligence (“Services”). This Privacy Policy explains how we collect and use the personal data and information of users who use or apply for Duelity Intelligence Services or visit any of our Websites. By using our Services, you agree to these terms. If you use our Services on behalf of an organization, you accept this Privacy Policy on behalf of that organization. The Data Controller determines the purposes and means of processing personal data.

GDPR (General Data Protection Regulation)

Regulation (EU) 2016/679 of the European Parliament and of the Council of April 27, 2016, on the protection of natural persons with regard to the processing of personal data and on the free movement of such data, and repealing Directive 95/46/EC (General Data Protection Regulation).

Personal Data (or Data)

Any information relating to an identified or identifiable natural person (“data subject”); an identifiable natural person is one who can be identified, directly or indirectly, in particular by reference to an identifier such as a name, an identification number, location data, an online identifier, or one or more factors specific to the physical, physiological, genetic, mental, economic, cultural, or social identity of that natural person.

 

Processing

An operation or set of operations performed on personal data or sets of personal data, whether by automated or non-automated means, such as collection, recording, organization, structuring, storage, adapting or modifying, retrieving, consulting, using, disclosing by transmission, dissemination, or otherwise making available, aligning or combining, restricting, erasing, or destroying.

User

Means any individual who uses or applies for the Services or visits any of our Websites, and to whom the Personal Data relates.

Privacy Policy Updates

Duelity Intelligence processes personal data in accordance with the GDPR and other data protection laws applicable to Duelity Intelligence. Due to the rapidly evolving nature of the Internet, Duelity Intelligence may update this Privacy Policy from time to time. If there is a change in how personal data is collected or used, Duelity Intelligence will post a clear notice of the change along with the updated Privacy Policy on our Services. Registered Users will be notified of the change before it takes effect. Duelity Intelligence encourages you to review this Privacy Policy regularly. Your continued use of the Service and/or continued provision of personal data to us is subject to the terms of the currently effective Privacy Policy.

Types of data collected

When you use our Services, you provide us with information such as files, content, emails, contacts, etc. This Privacy Policy does not grant us any rights to your Personal Data, except for limited rights necessary to provide the Services. We need your consent for actions such as storing your Personal Data, backing it up, or sharing it at your request.

Our Services offer features such as photo thumbnails, document previews, email organization, and easy sorting, editing, sharing, and searching. These features may require our systems to access, store, and scan your Personal Data.

Failure to provide certain Personal Data may prevent us from providing all Services. Users are responsible for any Personal Data of third parties. By providing the Services with Personal Data of third parties, Users declare that its processing is lawful and that at least one of the grounds listed in Article 6(1) of the GDPR applies.

You can contact Duelity Intelligence via email or through the contact forms at https://duelity.io/contact or the Call Center. In each of these cases, we collect the following Personal Data:

  • first and last name
  • phone number
  • email address
  • other information provided in the contact forms or in emails

In this case, the purpose of the processing of personal data, and at the same time the legal basis for such processing, is the performance of a contract to which the User is a party, or the taking of steps at the User’s request prior to entering into a contract (Article 6(1)(b) of the GDPR).

Rights of data subjects

Under the GDPR, users have the following rights:

  • Right of access to personal data (Article 15 of the GDPR) – The user has the right to obtain information as to whether their personal data is being processed and, if so, to access that data.
  • Right to rectification (Article 16 of the GDPR) – The user has the right to request the immediate rectification of inaccurate Personal Data.
  • Right to erasure (“right to be forgotten”) (Article 17 of the GDPR) – You have the right to request the erasure of your Personal Data when it is no longer necessary for the purposes for which it was collected.
  • Right to restriction of processing (Article 18 of the GDPR) – The user has the right to request that the processing of their Personal Data be restricted.
  • Right to data portability (Article 20 of the GDPR) – You have the right to receive your Personal Data in a structured, commonly used, and machine-readable format.
  • Right to object (Article 21 of the GDPR) – The user has the right to object to the processing of their Personal Data at any time.
  • Right to withdraw consent – where Processing is based on consent, the User has the right to withdraw consent at any time, without affecting the lawfulness of Processing carried out prior to such withdrawal.
  • Right to lodge a complaint with a supervisory authority – You have the right to lodge a complaint with the competent supervisory authority (in Poland: the President of the Personal Data Protection Office, ul. Stawki 2, 00-193 Warsaw).

How we process data

The Data Controller processes Users’ Personal Data in an appropriate manner and implements appropriate security measures to prevent unauthorized access, disclosure, modification, or destruction of Personal Data. The processing of Personal Data is carried out using computers and/or IT tools, in accordance with organizational procedures strictly related to the specified purposes.

In addition to the Data Controller, in some cases Personal Data may be accessible to specific categories of individuals involved in the operation of the website (administration, sales, marketing, legal department, systems administration) or third parties (such as external technical service providers, carriers, hosting providers, cloud service providers, IT companies, and communications agencies), designated as Data Processors by the Data Controller as needed. A current list of these entities may be obtained from the Data Controller at any time.

As a general rule, Duelity Intelligence does not transfer Personal Data to third countries or international organizations. If such a transfer is necessary, it will be carried out exclusively in accordance with the provisions of Chapter V of the GDPR, using appropriate safeguards, such as standard contractual clauses approved by the European Commission.

Duelity Intelligence does not use automated decision-making, including profiling, that would produce legal effects on Users or similarly significantly affect them.

Data retention period

Personal Data is processed for the time necessary to provide the Services requested by the User or as specified for the purposes described in this document. Duelity Intelligence will delete Personal Data after this period, except in cases where its retention is necessary to comply with legal obligations, resolve disputes, or enforce agreements.

Any person who has consented to the processing of their personal data for marketing purposes and to receive the newsletter has the right to withdraw their consent at any time, without affecting the lawfulness of the processing carried out prior to such withdrawal.

Recipients of Personal Data

The recipients of Personal Data are entities providing technical services to Duelity Intelligence. All entities processing Personal Data on behalf of Duelity Intelligence operate under appropriate data processing agreements that ensure an adequate level of personal data protection in accordance with the GDPR.

Legal action

The User’s Personal Data may be used by the Data Controller for legal purposes, in court, or during proceedings leading to potential legal action resulting from the improper use of the Services. The User acknowledges that the Data Controller may be required to disclose Personal Data upon request by public authorities.

Cookies

The Services do not automatically collect any information, except for information contained in cookies (“Cookies”). Cookies are files stored on a computer or other devices used to visit the Websites. They are created during a visit to the Websites. They contain the name of the Website they originate from, their storage duration on the end device, and a unique number.

Duelity Intelligence uses cookies for the following purposes:

  • to tailor the Website to the User’s preferences and optimize the User’s experience on the Website—in particular, cookies identify the device and enable the Website to be displayed appropriately, tailored to the User’s individual needs;
  • to generate statistics that help Duelity Intelligence understand how Users interact with the Services, thereby enabling improvements to their structure and content;
  • to maintain the User’s session (after logging in to the Services), so that the User does not have to re-enter their username and password on every page of the Website.

Websites use two basic types of cookies:

  • session cookies – temporary files stored on the User’s device until they log out or leave the Website;
  • Persistent cookies – cookies stored on the User’s device for the period specified in the cookie settings or until the User deletes them.

Duelity Intelligence uses the following types of cookies:

  • Essential cookies – cookies that enable the use of the Services, such as authentication cookies used in Services that require authentication on the Website;
  • Security cookies – used, for example, to detect fraud on the Websites;
  • performance cookies – which collect information about how the Services are used;
  • functional cookies – which allow the website to “remember” the User’s settings;
  • Statistical cookies – used to track statistics on the Websites.

Users may consent to the storage of cookies from the Websites on their device through the settings of the software used to browse the Websites. Users may change their cookie settings at any time. Detailed information about the options and methods for managing cookies is available in the software settings (web browser). Please note that restricting the use of cookies may affect certain functionalities of the Services. The use of essential cookies does not require the User’s consent and is based on the Controller’s legitimate interest in accordance with Article 6(1)(f) of the GDPR.

Legal basis for processing – summary

Duelity Intelligence processes Users’ Personal Data only in cases where such processing is necessary to provide the Services or to take steps at the User’s request prior to entering into the Services, in particular:

  • Provision of Services to the User – legal basis: Article 6(1)(b) of the GDPR (performance of a contract);
  • Administration of the Services – legal basis: Article 6(1)(b) of the GDPR (performance of a contract);
  • Handling user inquiries and requests – legal basis: Article 6(1)(b) of the GDPR;
  • compliance with legal obligations – legal basis: Article 6(1)(c) of the GDPR;
  • Marketing purposes and the newsletter – legal basis: Article 6(1)(a) of the GDPR (User consent);
  • the Controller’s legitimate interests (e.g., website security) – legal basis: Article 6(1)(f) of the GDPR.
